Terms
& Conditions for Use
The
paragraphs below are the terms and conditions for use of the wireless and wired
hotspot network services (the "Service") supplied by WalkinWiFi™ Limited to you
("You/Your"). By accepting the following Terms & Conditions you confirm
that you have read, understood and accept these Terms & Conditions™.
WalkinWiFi™ Limited Obligations and Rights:
WalkinWiFi™
Limited will not disclose Your contact information to any third party without
Your consent, except (a) to companies with which We have contracted for the
provision of the Service, but only for purposes of providing the Service to
You; or (b) for WalkinWiFi™ Limited’s cooperation with legal authorities and/or
third parties in the investigation of any suspected or alleged crime or civil
wrong, including the unauthorized disclosure of your contact information, but
only if We are required to do so by law.
You agree
to receive emails and text (SMS) messages from your "Home Location" advising
you of special offers, events and general information about that location in
exchange for the FREE use of the WalkinWiFi™ Limited service. You also agree to
receive occasional emails and text (SMS) messages from WalkinWiFi™ Limited.
WalkinWiFi™
Limited will use reasonable efforts to provide uninterrupted access to the
Service. WalkinWiFi™ Limited will, if practical and possible, perform routine
maintenance outside of normal business hours, and will, whenever possible,
provide advance notice of maintenance or other suspension of service. However,
We may modify or temporarily suspend the Service or any part of it without
notice to You for emergency technical repair.
Any
security that You have when using the Internet or Your corporate intranet is
unaffected by Your use of the Service. WalkinWiFi™ Limited provides no more or
less security than what You already have, because We provide access only and do
not interfere in any way with content. For that reason, We cannot be, and are
not responsible for the security of the information You transmit when using the
Service. Further, WalkinWiFi™ Limited is not responsible for the accuracy,
completeness or timeliness of any information obtained from the Internet or
Your corporate intranet by You when using the Service.
WalkinWiFi™
Limited, may log traffic from the Service for reasons of monitoring quality of
service and security, and for the detection and prevention of abuse to the
Service.
WalkinWiFi™
Limited shall not be liable to You under any circumstance(s) for any indirect,
special or consequential losses, lost profits, business interruption,
information or loss of data, security breach, loss of goodwill or other
pecuniary loss, including loss or damage suffered as a result of any virus,
denial of the Service, spamming or hacking.
End User’s Obligations and Rights
You are
responsible for (a) maintaining the confidentiality of your user ID; and (b)
all activities that occur under. You are liable for all direct losses, damage,
costs and expenses suffered by WalkinWiFi™ Limited due to the loss, misuse and/or
disclosure of Your user ID.
You must
not do anything, which may violate, or which violates any applicable law or
regulation or do anything, which may directly or indirectly interfere or which
interferes with or may disrupt or which disrupts the Service or servers or
networks connected to the Service.
WalkinWiFi™
Limited offers the Service for activities such as the active use of e-mail,
instant messaging, browsing the World Wide Web and accessing corporate
intranets. High volume data transfers, especially sustained high volume data
transfers, are not permitted. Disclosing user ID to any third party is
prohibited, unless explicitly permitted in writing by WalkinWiFi™ Limited.
Hosting a web server or any other server by the use of the Service is prohibited.
You may not access someone else’s account, send unsolicited bulk e-mail,
collect other people’s personal data without their knowledge and consent and
You may not otherwise interfere with other users’ use of the Service. WalkinWiFi™
Limited, may suspend the Service if WalkinWiFi™ Limited reasonably believes
that (a) Your use of the Service is unreasonably excessive (i.e., in excess of
one gigabyte per month, or the use of peer to peer P2P file sharing to access
illegal content); and/or (b) You are using the Service for criminal and/or
illegal activities.
You are not
eligible for any compensation if You cannot use the Service because (a) there
is a general power outage at the location You are attempting to access the
Service from; (b) the location is undergoing maintenance as previously
scheduled; or (c) the Service has been suspended because of a failure outside
of WalkinWiFi™ Limited’s reasonable control.
You may not
use the WalkinWiFi™ Limited network to attempt to circumvent user
authentication or security of any host, network or account. This includes but
is not limited to, accessing data not intended for You, logging into a server
or account You are not expressly authorized to access, password cracking,
probing the security of other networks in search of weaknesses, or violation of
any other organisation’s security policy.
You may not
resell this Service to a third party.
General Information
These terms
and conditions and all other legal relationships between WalkinWiFi™ Limited
and You shall be governed by the laws of England.
WalkinWiFi™
Limited, may revise, amend or modify these Terms & Conditions, its other
policies and agreements, and will be effective for (a) existing users 10 days
after the date of publication; and (b) new users on the date of publication.
